1. Purpose and Scope

These General Terms and Conditions of Sale govern the sale of products concluded between:

The Company : ELITESHELL SA, a company incorporated under Swiss law, with its registered office at Chantepoulet 12, 1201 Geneva, registered in the Commercial Register under no. CHE-350.125.74 (hereinafter “we” or the “Seller”),
nd any adult individual acting as a consumer within the meaning of the applicable law in their country of residence (hereinafter the “Customer” or “you”),
for the purchase of suitcases and accessories via the Eliteshell.com website.

These General Terms and Conditions apply to all orders placed online for delivery to Switzerland, the European Union or third countries, subject to any mandatory local laws that provide greater protection to the consumer.

2. Pre-contractual Information

Before placing any order, the Customer acknowledges having read and understood:

the essential characteristics of the products,
prices, delivery times, shipping costs and payment terms,
these General Terms and Conditions, and accepts them without reservation.

3. Order

The ordering process includes:

Selecting the products and adding them to the shopping cart,
Entering the delivery and billing details,
Acceptance of the General Terms and Conditions by ticking a checkbox,

Once the order has been completed, an acknowledgement of receipt is sent automatically. The contract is deemed concluded when the shipping confirmation is sent.
We reserve the right to refuse or cancel any order in the event of suspected fraud, misuse, or previous non-payment.

4. Products, Availability and Quantities

Products are offered subject to availability.
If a product is unavailable, the Customer will be informed by email.
Quantities per order may be limited (maximum 8 units per model/SKU) in order to prevent abuse.

5. Prices and Fees

Prices are displayed in Swiss francs (CHF), including Swiss VAT. For customers located outside Switzerland, prices are displayed in euros (EUR), excluding VAT..
Shipping costs are specified before payment. Customs duties, import taxes and any additional charges related to international delivery are the responsibility of the Customer and may be requested by local authorities or the carrier.
For international deliveries, the Customer is responsible for ensuring compliance with local customs regulations.

6. Payment

Payment is made online by credit or debit card (Visa, Mastercard) via a secure payment solution.
The order is considered confirmed only upon successful receipt of payment.

7. Delivery

Delivery Times

Orders are dispatched within 2 to 3 business days.
Delivery times vary depending on the destination country. Delays shall not give rise to any claim for damages, except in cases of gross negligence.

Delivery Areas

We deliver to Switzerland, the European Union and internationally.
PO boxes and hotels are not accepted as delivery addresses.

International delivery conditions (Incoterms)

For international deliveries outside Switzerland, delivery is made under the Incoterm DAP (Delivered At Place) – Incoterms® 2020. Transport costs are borne by the Customer and are specified at the time of the order. The place of destination corresponds to the delivery address provided at the time of the order.

8. Right of Withdrawal / Returns

8.1. Customers in Switzerland

Swiss law does not provide for a statutory right of withdrawal.

As a commercial gesture, we offer a voluntary 14-day return period from the date of receipt of the order, provided that the products are:

unused;
in their original condition and packaging;
accompanied by proof of purchase.

The customer must inform ELITESHELL of their return request before sending the product back.

Return shipping costs are the responsibility of the customer, except in the event of an error on our part. The refund will be issued after receipt and inspection of the returned product, using the same payment method used for the order.

8.2. Consumers in the European Union

In accordance with Directive 2011/83/EU, you have a statutory right of withdrawal of 14 days from the date of receipt of the product, without having to provide any reason.

To exercise this right, you must inform ELITESHELL of your decision to withdraw before the expiry of this period. A withdrawal form is available upon request.

After notifying ELITESHELL of your withdrawal, the product must be returned within 14 days. The direct costs of returning the product are borne by the customer, except in the event of an error on our part.

Le client pourra être tenu responsable de toute dépréciation du produit résultant de manipulations allant au-delà de ce qui est nécessaire à cette vérification.

We will refund all payments received, including the initial standard delivery costs, using the same payment method used for the order. ELITESHELL may withhold the refund until the returned product has been received or until the customer provides proof that it has been shipped, whichever occurs first. The refund will then be made without undue delay, in accordance with the applicable provisions governing the right of withdrawal.

8.3. Customers Outside Switzerland and the European Union

As a commercial policy, we offer customers outside Switzerland and the European Union a voluntary 14-day return period from the date of receipt of the order, provided that the products are:

unused;
in their original condition and packaging;
accompanied by proof of purchase.

The customer must inform ELITESHELL of their return request before sending the product back.

9. Warranty

Our products are covered by the following warranties:

Nestable : commercial warranty of 12-year against manufacturing defects.
Accessories : warranty of 3 years.

The warranty does not cover:

normal wear and tear,
damage caused by impacts, misuse or improper transportation.

10. Réserve de propriété

Les produits demeurent notre propriété jusqu’au paiement complet du prix (art. 715 CO).
The risk passes to the customer upon delivery.

11. Liability

We accept no liability in the event of:

improper use of the products,
errors or omissions on the Website,
indirect or non-material damages.

Our liability is limited to the total amount of the order, unless otherwise required by mandatory legal provisions.

12. Intellectual Property

All content on the Site (texts, images, videos, design, structure and trademarks) is protected by applicable copyright, intellectual property and related rights laws

ELITESHELL® is a registered trademark in Switzerland under No. 829360 and is the subject of International Registration No. 1888573, with protection notably in the European Union and the United Kingdom.

Any reproduction, representation, modification, distribution or use, in whole or in part, of this content or of the ELITESHELL® trademark without prior authorisation is prohibited, except where otherwise permitted by law.

13. Data Protection

We comply with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the GDPR.

14. Mediation and Dispute Resolution

In the event of a dispute, an attempt may be made to resolve the matter amicably through mediation.

For Swiss customers: a mediation request may be submitted to a recognised mediation service.

15. Applicable Law and Jurisdiction

These General Terms and Conditions are governed by Swiss law, without prejudice to any more favourable mandatory provisions applicable in your country of residence.
In the event of a dispute, the courts of the Canton of Geneva shall have jurisdiction, unless otherwise provided by law.
